Supreme Constitutional Court: EDY Decision-Making Must Be Done by the Same Members Throughout the Process

The Supreme Constitutional Court (SCC) accepted the appeal of the Attorney General against a decision of the Administrative Court regarding the composition of the Public Service Commission (PSC). The SCC ruled that the process of discussion and decision-making on a matter must be carried out by the same members of the PSC from beginning to end. The case concerned a member of the PSC who was absent from a meeting and then participated in a subsequent meeting on the same matter, having been informed of the previous decisions. The SCC ruled that simple information is not sufficient and that the member's participation in a later meeting renders the entire process voidable, as they did not contribute to the initial decision-making.
