European Parliament Sends EU-Mercosur Deal to Court – Commission May Pursue Provisional Application

The European Parliament has decided to refer the EU-Mercosur agreement to the Court of Justice of the European Union for legal review, by a narrow margin (ten votes). The decision concerns questions about the legality of dividing the agreement into EMPA and ITA, as well as its compatibility with fundamental principles of EU law. Despite the referral, the European Commission retains the right to seek the provisional application of the agreement, pending the Court's decision, which could take up to two years. The Commission expresses dissatisfaction with the decision, arguing that the legal issues have already been addressed. However, the majority in Parliament believes that legal clarification is needed before the final approval of the agreement. The vote took place amid strong protests from farmers in Strasbourg. The Commission is optimistic that it can reverse the situation in a new vote, given the support from the major political groups.
