Cyprus Court of Appeal Rules German Courts Have Jurisdiction in Child Custody Case

The Cyprus Court of Appeal dismissed an appeal by a father regarding the parental custody of his four minor children, upholding the decision of the Limassol Family Court. The court ruled that it lacks jurisdiction to hear the case, as the children permanently reside in Germany. The father had filed an application for custody, care, and establishing Cyprus as the children's place of residence, but the mother contested the Cypriot court's jurisdiction, arguing that the move to Germany was with the father's consent as part of a divorce agreement. Furthermore, a German court had already rejected the father's application for the children's return to Cyprus. The Court of Appeal, considering the children's habitual residence in Germany, their education there, and the presence of relatives in Germany, affirmed the first instance court's decision.
