Appeal Rejected – Path Cleared for Ballot List Approval in DISY

The appeal of Limassol MP Nikos Sykas to be reinstated on the DISY party’s candidate list has been rejected by the Court, at least in the first instance. The Court ruled that there is currently no irreparable damage and that granting the request would be preliminary in nature, affecting the main case regarding the legality of the decision to exclude him from the ballot list. Mr. Sykas’s request concerned the issuance of a decree preventing the Supreme Council of DISY from approving the decision of the Political Bureau to remove him from the ballot list. The case concerns the interpretation of the party’s statutes and the legality of the process followed. With its decision, the Court gives the “green light” for the Supreme Council of DISY to convene and decide on the final approval or not of the ballot list. Mr. Sykas, however, retains the right to challenge the process and the decision of the Supreme Council later. The Court stressed that the current state of the case does not allow for the issuance of a short-term decree, as the main lawsuit and the decision of the Supreme Council are pending. At the same time, it left open the possibility for Mr. Sykas to appeal again to the Court if he is ultimately removed from the ballot list.
