Anti-Corruption Authority Responds to Concerns over Disclosure of PEP Information

The Anti-Corruption Authority has responded to a letter from a lawyer representing a former Director of the Fisheries Department, who is mentioned in the Authority's report. The Authority emphasized that the publication of the report is a summary of the original 275-page investigation and that its revision is practically impossible. Furthermore, the Authority assured that it does not characterize the official as "guilty," but refers to "potential criminal liabilities." Regarding allegations of a lack of institutional neutrality and targeting, the Authority responded that the former Director, due to his position, was considered a Politically Exposed Person (PEP). According to recommendations from the Data Protection Commissioner, the disclosure of PEP data is permitted when it serves the public interest and the right to information. The Authority stressed that the practice of protecting PEPs from data disclosure, in contrast to other public officials, should change. It seeks to establish correct criteria for the disclosure of personal data, while ensuring transparency and accountability. Finally, the Authority assured that there was no intention to target the lawyer's client, nor any unfavorable treatment compared to other public officials. This response aims to clarify the Authority's position and safeguard its independence and integrity.
