The Supreme Court of Cyprus has rejected the appeal of an Israeli citizen, upholding the search warrant issued in connection with a case alleging the administration of cocaine and indecent behavior towards a woman. The case concerns an incident at a nightclub in Limassol, where the accused allegedly administered narcotics to the complainant, causing her to become semi-conscious and followed by indecent physical contact. The woman reported the incident to the Police, with tests revealing the presence of cocaine in her system, although she denied using drugs. The search warrant was issued based on testimony suggesting that evidence, such as narcotics and the clothes worn during the incident, could be found in the accused's home and vehicle. The accused appealed to the Supreme Court, arguing that there was insufficient evidence linking the items sought to the places being searched. However, the court ruled that the circumstances justified the existence of reasonable suspicion and that the testimony regarding the administration of drugs, combined with the results of medical examinations, could reasonably lead to the conclusion that narcotics might be present in his home or vehicle. The Supreme Court emphasized that the issuance of a search warrant requires reasonable cause to believe that items related to the commission of a criminal offense are located in a specific place. The concept of 'reasonable suspicion' sets a low evidentiary threshold and does not require full proof of the offense, but sufficient evidence to create a possibility of locating relevant evidence.
