Supreme Court Rejects Heir's Claim to Survivor's Pension

The Supreme Constitutional Court has rejected a request from an heir for the right to a survivor's pension, ruling that this right is inextricably linked to the person entitled to it and is not transferable to their heirs. The case concerned an applicant whose request for a survivor's pension had been rejected, and after his death, his heir attempted to continue the legal dispute to claim the right. The Administrative Court had already rejected the heir's request, ruling that the survivor's pension is a personal right. The Supreme Constitutional Court, acting as an appellate court, agreed with the Administrative Court's decision, citing relevant case law. The decision emphasizes that the needs and conditions justifying the granting of the survivor's pension are directly linked to the person of the applicant and cease to exist upon their death. Consequently, the Supreme Constitutional Court dismissed the heir's appeal and awarded costs to the Republic. This decision clarifies that the survivor's pension is not part of the inheritance estate and cannot be claimed by the heirs.
