Serious Deficiencies in Refugee Law Identified by Children's Rights Commissioner

The Children's Rights Commissioner has identified serious deficiencies in the draft law “The Refugees Law of 2026”, submitting a memorandum with suggestions and observations to the House Interior Committee. While acknowledging certain positive provisions, such as the enshrining of the best interests of the child, she points out that the bill does not guarantee a fully child-centered asylum system. The main deficiencies identified include the lack of independent representation for unaccompanied minors, the maintenance of a dual role (guardian and representative) within the same authority, and the possibility of detaining children, even as a “last resort”. The Commissioner expresses particular concern about the detention of children, characterizing it as a setback. Furthermore, the lack of clarity regarding the competent authority that assesses the best interests of the child is highlighted, as well as the absence of a comprehensive regulatory framework for the operation of reception centers. The placement of unaccompanied children in adult facilities is considered unacceptable and should be expressly prohibited. The Commissioner calls for the incorporation of her recommendations into the bill, to ensure the full protection of the rights of children seeking asylum in Cyprus.
