The Consumer Protection Service (CPS) has imposed a €160,000 fine on Alpha Bank Cyprus Ltd for abusive terms in mortgage loan agreements. The CPS initiated an investigation based on the Consumer Protection Law, examining the terms of mortgage loans offered by Cypriot banks. The investigation began with a request to the bank for sample contracts and related documents. The CPS found that certain terms lacked sufficient transparency and created an imbalance between the rights of the bank and consumers. Particular emphasis was placed on clause 1.2 regarding the purpose, amount, and disbursement of the loan, which was deemed unclear regarding payment methods and disbursement conditions. Alpha Bank argued that the disbursement method depends on various factors and that there is communication with the borrower, however, the CPS stressed that this practice does not replace the obligation of transparency in contractual terms. The CPS highlighted that the consumer cannot know the bank's practices, which may change unilaterally. The CPS's decision underscores the importance of transparency and balance in loan agreements to protect consumer rights. The bank has the right to appeal the decision.
