The Supreme Court of Cyprus rejected an application by a life prisoner, serving a sentence for two murders, for permission to file a petition for a prerogative order (Mandamus) against the Prison Department. The prisoner requested that the Prison Department be compelled to protect his physical integrity, health and safety, as well as to ensure his personal property and not treat him in a humiliating manner. The Court noted that this was the prisoner's second similar application, which had already been rejected in the past. It emphasized that the prerogative order Mandamus is issued only for specific actions and not for general obligations, while the prisoner's requests were too general. At the same time, the Court reminded that prisoners retain their fundamental rights, but in case of violation of these rights, they can appeal to civil courts. Taking into account the generality of the request and the previous rejection, the Court ruled that the new application was abusive and rejected it.
