The 'Obligation' of EU Member States for Mutual Assistance

The article examines the obligation of European Union member states to provide mutual assistance in the event of an attack, as defined in Article 42.7 of the Treaty on European Union (TEU). This clause obliges member states to provide assistance "by all the means at their disposal" if another member state falls victim to an armed attack. The EU's mutual defense clause differs from Article 5 of NATO, as the EU clause is more based on intergovernmental and bilateral assistance, while the NATO clause reflects a broader principle of deterrence. Article 42.7 is considered more “inclusive” than Article 5, as it requires providing assistance “by all means”, while Article 5 gives greater national discretion. However, the effectiveness of the EU's mutual defense clause remains doubtful, as its implementation depends on the political will of the member states and their ability to coordinate their actions.
