Simon Iacout's Transfer is a Choice, Not an Obligation

Cyprus Parliamentary Candidate Chrysovalantis Charalambous analyzes the issue of the possible transfer of Simon Iacout, who was convicted of usurping Greek Cypriot properties in the occupied territories, to an Israeli prison. Mr. Charalambous points out that the transfer is not an obligation for Cyprus, but a choice that falls within the discretion of the government. He explains that the European Convention on the Transfer of Prisoners, signed by both Cyprus and Israel, does not require the transfer, but allows it only with the express consent of the sentencing state. In addition, the existence of double criminality is required, i.e. Israel must have legislation that criminalizes the acts for which Iacout was convicted. Mr. Charalambous emphasizes that this case does not concern a common crime, but the systematic exploitation of refugee properties in occupied territory. The enforcement of the sentence in Cyprus, according to him, is part of the state's institutional response to these actions. He expresses the opinion that the transfer of Iacout would weaken the deterrent message of justice and create the impression that the sentence can be avoided. He concludes that Cyprus has both a legal right and a political and moral duty to refuse the transfer, in order to protect the rights of refugees and the sovereignty of the country.
