Reservations Regarding Proposal for Mutual Information in Corruption Cases

The bill proposed by independent MP Irene Charalambidou for immediate mutual information between the Anti-Corruption Authority and the Tax Commissioner in corruption cases, received a positive response from Transparency Commissioner Haris Poyiatzis and Tax Commissioner Sotiris Markidis. The purpose of the proposal is to establish a communication channel to avoid political interference in tax audits arising from findings of the Anti-Corruption Authority. Mr. Markidis clarified that he has not received political interference, but believes it is ethically right to inform the Police or the Legal Service before conducting a tax audit in a case investigated for corruption. The Legal Service and the Auditor General expressed reservations about potential legal obstacles from the parallel conduct of criminal investigations and tax audits, emphasizing the need for coordination. Mr. Poyiatzis suggested including in the bill a provision for informing the Tax Commissioner also about findings concerning public officials. The discussion in the Parliamentary Institutions Committee highlighted the need for clarification of the wording of the proposal and to ensure the discretion of the Tax Commissioner.
