Limited Transparency for Beneficial Owners of Companies

Parliament has approved a new legal framework for access to information on the ultimate beneficial owners of companies, but it provides limited access, primarily due to the protection of personal data. Although Cyprus was obliged to comply with a European directive, access to information through electronic registers will not be open to the general public. Access will be limited to competent authorities, obligated entities, and those who can demonstrate a legitimate interest, such as for the prevention of money laundering and terrorist financing. This regulation came about following a decision by the Court of the European Union, which ruled that unrestricted access to registers violates the right to privacy. The Department of Registrar of Companies suspended public access to the Register of Beneficial Owners in November 2022, awaiting the new legislation. The consultation process for the bill was lengthy and faced objections from various stakeholders.
