Compensation Increased to €160,000 for Pedestrian Hit by Vehicle in Limassol

The Supreme Court has increased the compensation to be paid to a pedestrian who was hit by a vehicle in Limassol to €160,000. The accident occurred on December 4, 2008, on Ierou Loxou Street, when the driver of a car collided with a 16-year-old pedestrian crossing the road. The Court ruled that the driver bore the primary responsibility for the accident, as he did not properly assess the visibility conditions and did not adjust his speed. At the same time, it was acknowledged that the pedestrian also bore some responsibility, as he did not properly assess the risk. The percentage of responsibility was allocated 80% to the driver and 20% to the pedestrian. The appeals and counter-appeals filed by the two parties were dismissed by the Court of Appeal, which confirmed the initial decision regarding the allocation of responsibility. The Court of Appeal emphasized the increased duty of care of drivers towards pedestrians, especially in nighttime conditions, and the need to adjust speed and use appropriate lights.
