Appeal Dismissed: 27-Year-Old's Rape Conviction Upheld

The Cyprus Court of Appeal dismissed the appeal of a 27-year-old man convicted of raping a woman in Limassol, upholding his nine-year prison sentence. The Court ruled that the sentence was not excessive, considering the exploitation of the victim's inability to consent due to severe intoxication, as well as the serious psychological impact she suffered. The case concerns an incident that occurred in 2022, where the complainant, in a state of severe intoxication, was taken to the defendant's apartment and subjected to a sexual act without the ability to give consent. The trial court had convicted the defendant of rape. The 27-year-old, in his appeal, argued that the sentence was excessive and that mitigating factors, such as his clean criminal record and age, had not been taken into account. However, the Court of Appeal found that the Criminal Court had considered both aggravating and mitigating factors. The Court emphasized that sexual offenses, and especially rape, require strict and deterrent penalties. Consequently, the Court of Appeal ruled that the nine-year prison sentence is justified and there is no error in its imposition. The appeal was dismissed and the original sentence remains in force.
