Supreme Constitutional Court Rejects Panikos Hatzipanagis' Appeal Regarding RIK News Director Position

The Supreme Constitutional Court unanimously rejected the appeal of Panikos Hatzipanagis regarding the annulment of his promotion to the position of Director of News and Current Affairs of the Cyprus Broadcasting Corporation (RIK). The initial decision was made by the lower court, which ruled that the RIK Board of Directors had exercised its discretion improperly, giving excessive weight to the oral interview and overlooking the seniority and qualifications of Yannis Nikolaou, who had also applied for the position. The position of News Director was advertised in 2016, with Yannis Nikolaou, Panikos Hatzipanagis, and four other candidates. The RIK Board had initially decided to promote Mr. Hatzipanagis, but this decision was challenged by Mr. Nikolaou. Mr. Hatzipanagis argued in his appeal that Mr. Nikolaou was not the only one who possessed the specific advantage, that he had been unfairly treated, and that the Board's reasoning was sufficient. However, the Supreme Constitutional Court rejected all grounds for appeal, confirming the original decision. The court emphasized that Mr. Nikolaou's advantage had already been accepted and binding during the initial proceedings. Furthermore, it reiterated that the Board's justification for choosing Mr. Hatzipanagis was inadequate, as it did not adequately explain the disregard for Mr. Nikolaou's seniority and advantage. The decision was accompanied by costs in favor of Mr. Nikolaou.
