The Court of Appeal rejected all appeals and fully upheld the original decision in the case of the death of 10-year-old Stavros Giorgallis, which had shocked the public. The decision concerns the conviction of Dr. Heraklis Pantelidakis and the acquittal of Dr. Kyriakos Kyriakides. The case concerned the death of Stavros in May 2018, after a head injury during a school activity, where the skull fracture was not detected by the treating physicians. The Court of Appeal ruled that there was no error in the original decision regarding the causal link between medical negligence and the child’s death, emphasizing that the incorrect diagnosis of the X-ray led to the incorrect management of the case and the child’s death. It was also pointed out that there was no neurosurgery clinic at the General Hospital of Larnaca, however, it was emphasized that the incorrect diagnosis deprived the possibility of calling a neurosurgeon and the timely transfer of the child to the General Hospital of Nicosia for appropriate treatment.
