The Supreme Court has ruled in favor of the Municipality of Larnaca in a case concerning the imposition of a rental fee on a property owner in Voroklini. The fee, amounting to €54, was levied for the year 2017 based on community regulations providing for a fee of up to 5% of rents, with the Municipality setting a rate of 2.5%. The owner had appealed to the courts, arguing that the measure constituted double taxation and violated administrative and tax law. The lower court had accepted the appeal, ruling that the principle of proportionality had been violated. However, the Supreme Court overturned the lower court's decision, accepting the Municipality's appeal. The Supreme Court found that the lower court had examined issues not raised in the pleadings, as the appeal was primarily based on the claim of double taxation and not on a violation of the principle of proportionality. The Supreme Court emphasized that the Municipality acted within the framework of the regulations, setting the fee at half the maximum permitted rate. This decision is a significant victory for the Municipality of Larnaca and confirms the legality of imposing the rental fee. Furthermore, the Supreme Court awarded the Municipality of Larnaca the costs of the case, recognizing the correctness of its position and the effort it made to defend it.
