Commission Opens Investigations into Google's Systems Based on the DSA

The European Commission has launched two fact-finding procedures against Google under the Digital Markets Act (DMA). These procedures aim to ensure Google's full compliance with the EU's new regulatory framework. One procedure concerns Google's obligation to provide free and effective interoperability with its Android operating system to third-party developers, particularly regarding features used by Google's Artificial Intelligence (AI) services, such as Gemini. The second procedure relates to the Google Search engine and the company's obligation to provide third-party search engine providers with access to anonymized ranking, search, click, and impression data on fair, reasonable, and non-discriminatory terms (FRAND). The Commission is examining the scope of the data, the anonymization method, and the terms of access, as well as the eligibility of AI chatbot providers. The Commission seeks to ensure equal opportunities for third-party providers to innovate and compete in the field of artificial intelligence and to improve their services, offering alternatives to users. The procedures are expected to be completed within six months, with the Commission communicating preliminary findings and measures within three months. These procedures do not constitute a decision of non-compliance, but do not limit the Commission's ability to impose sanctions in the event of a violation of the rules.
