EU Launches Investigation into Shein over Addictive Design and Illegal Content

The European Commission has launched an official investigation into Shein, the Chinese e-commerce platform, for potential violations of the Digital Services Act (DSA). The investigation focuses on three key areas: the platform's addictive design, the lack of transparency in its product recommendation systems, and the availability of illegal products, including child sexual abuse material. The investigation is based on preliminary analyses of risk assessment reports submitted by Shein itself, responses to requests for information, and evidence provided by third parties. The Commission has already sent three requests for information to Shein, seeking clarification regarding its compliance with the DSA, particularly concerning the protection of consumers and minors, as well as the transparency of its recommendation systems. The investigation will examine the measures Shein implements to restrict the sale of illegal products, such as content related to child sexual abuse, and the risks associated with the platform's addictive design. According to the DSA, Shein is obligated to disclose the key parameters used in its recommendation systems and to offer users options that are not based on profiling. The Commission emphasizes that addictive design can have negative impacts on user well-being and consumer protection. The investigation will last as long as necessary, depending on the complexity of the case and the level of cooperation from Shein. Ireland, through the Coimisiún na Meán, is participating in the investigation as the competent authority for the country where Shein is established in the EU. The Commission has the power to take further action, such as imposing temporary measures or issuing a decision of non-compliance, or to accept commitments from the company to remedy the violations.
