Supreme Court: Private Clinic and Doctor Liable for Delayed Heart Attack Diagnosis

The Supreme Court of Cyprus has confirmed the liability of a private clinic and an external doctor for the delayed diagnosis of a heart attack in a patient in 2009. The patient visited the clinic complaining of stomach pain and nausea, but a correct diagnosis was not made, either by the emergency room doctor or by the external gastroenterologist who was called in. Despite signs of an acute myocardial infarction on an electrocardiogram, the diagnosis was delayed for several hours, resulting in extensive myocardial necrosis and permanent heart damage to the patient. The delay in diagnosis led to a permanent reduction in the patient's cardiac function by 30-40%, requiring lifelong medication and an implantable defibrillator. The Limassol District Court had already found the clinic and the doctor liable, attributing responsibility to the clinic for the actions of its staff and to the doctor for failing to evaluate the electrocardiogram. The Supreme Court dismissed the appeals of the clinic and the doctor, upholding the damages awarded to the patient, which amount to approximately half a million euros. The court emphasized that the appeals essentially challenged the facts as established by the District Court. This case highlights the importance of early and accurate diagnosis in cases of cardiac events and the serious consequences that a delay can have, as well as the responsibility of medical institutions and doctors to provide quality healthcare.
