Donors to the Support Agency: Names and Amounts Will Not Be Sent to Parliament – Legal Service Opinion

The Auditor General of the Republic, as treasurer of the Independent Social Support Agency (ISSA), will not submit to Parliament the list of donors and the amounts of donations from 2020 onwards. This decision is based on an opinion from the Legal Service, which states that there is no legal basis for disclosing this information and that its publication could lead to administrative sanctions. In his letter to the chairman of the Parliamentary Institutions Committee, the Auditor General states that the publication of the information would violate EU law and the principles of personal data protection. He adds that, in the event of a new request, it must be adequately justified and limited to absolutely necessary data. The ISSA is willing to provide further information subject to certain conditions, such as replacing the names of natural persons with their initials, concealing the identity of legal persons, and limiting the time period of the requests. In addition, the information to be transmitted must be classified as confidential.
