DIKO Proposes Law to Regulate Foreclosures

DIKO has submitted a bill to Parliament to regulate foreclosures, proposing the possibility of appointing special judges by the Supreme Court to resolve financial disputes between borrowers, guarantors and creditors. These judges will be able to hear cases concerning the amount of the loan, the outstanding balance, abusive clauses and other issues arising from the loan agreement. During the hearing, the borrower will have the right to request the suspension of the foreclosure notice, with the court being able to issue a suspension order for 9 months. After this period, the lender will be able to proceed with a new notice, unless the Court decides otherwise. The president of DIKO, Nikola Papadopoulos, stated that this proposal will allow for faster adjudication of cases due to the expertise of the judges, will give borrowers the opportunity to negotiate their debt and will create a constructive timeline for resolving cases. The aim of the proposal is to reward consistent borrowers and prevent abuse of the system by bad debtors, through the cooperation of the executive and judicial branches.
