Cyprus: Appeal Court Rules on Responsibility for Construction Site Accident

A years-long legal dispute regarding a work accident in Nicosia in 2006 concluded with a modification of the initial court decision. Izzet Ibrahim, a formwork assistant, was seriously injured after falling from a height of 2.70 meters while removing formwork from a construction site. He later passed away from unrelated causes, with the lawsuit continuing through his estate administrator. The court had already determined compensation of 110,000 euros, with the disagreement focusing on liability. The initial court had assigned responsibility to both the contracting company and the subcontractor, while exonerating the property owner. The contracting company appealed, challenging the evaluation of testimonies and the termination date of its contract. However, the Court of Appeal largely upheld the initial decision, emphasizing that the evaluation of testimonies is primarily the responsibility of the lower court and that there were no grounds to overturn its judgment.
