The Supreme Constitutional Court rejected an appeal against the cancellation of a tender launched by the University of Cyprus in 2019 for mechanical works for the construction of buildings for the Department of Biological Sciences. The tender was cancelled because the bid of the company proposed for award exceeded the budgeted cost by 35%. The Evaluation Committee had initially proposed awarding the contract to the company, believing that the low cost estimate was due to an error and would not affect competition. However, the Rector of the University, outside his jurisdiction, requested the opinion of the Audit Office, which proposed a re-tender with the correct cost estimate. The Tender and Finance Committee of the University ultimately decided to reject the bid, considering the price unrealistic. This decision was upheld by the Review Authority and now by the Supreme Constitutional Court, rejecting the company's appeal. The cancellation of the tender and the rejection of the appeal highlight the importance of transparency and legality in public procurement, as well as the need for accurate cost estimation of projects.
