The Consumer Protection Service (CPS) has imposed a fine of €160,000 on Alpha Bank Cyprus Ltd, deeming certain terms in its mortgage loan agreements to be abusive. The CPS initiated an investigation based on consumer protection law, examining mortgage contracts due to their high value, long duration, and security against primary residences. The investigation revealed that some terms lacked sufficient transparency and created an imbalance between the bank and consumers. Particular emphasis was placed on the clause regarding the purpose, amount, and disbursement of the loan, as it did not clearly specify payment methods and disbursement criteria. Alpha Bank argued that the disbursement method depended on various factors and that there was communication with the borrower, however, the CPS stressed that this practice did not replace the obligation of transparency in contractual terms. The CPS ruled that the vague terms violated consumer protection regulations and imposed the fine, aiming to ensure transparency and balance in the relationship between banks and consumers.
