Administrative Court: Building Permit for the Asphalt Plant in Mitsero is Legal - Appeal of 8 Communities Dismissed

The Administrative Court has dismissed an appeal by eight communities against the Republic regarding the building permit for the relocation of an asphalt plant from Dali near Mitsero. The appeal was filed by the communities of Mitsero, Agrokipia, Agios Ioannis, Kato Moni, Aradiou, Meniko, Malounta and Orounta. The decision follows the overturning of a previous decision by the Court of Appeal, which had annulled the permit due to the failure to consult with the affected communities. The Court of Appeal ruled that the failure to consult had been wrongly established and referred the case back to the Administrative Court. In its recent decision, the Administrative Court ruled that the Administration's decision is correct and legal, without any legal or factual errors and is compatible with the policy for such developments. It also dismissed claims of unconstitutionality and violation of the European Convention on Human Rights. The case was handled by the Legal Service, with Prosecutor Elena Papageorgiou, Senior Lawyer Theodora Piperi-Christodoulou and Lawyer Thasos Chatziloukas.
