After 30 years, the case of H.K., who became a quadriplegic following a traffic accident in Nicosia in 1995, is being reopened. The Supreme Court overturned the dismissal of his lawsuit against the Attorney General and the Municipality of Lakatamia and ordered a priority retrial. The initial lawsuit against the driver was dismissed, as he was not found responsible. The new lawsuit is directed against the authorities, alleging that they failed to take safety measures, such as lighting the Morphou Avenue and creating a pedestrian crossing, which contributed to the accident. The Supreme Court ruled that the lower court had no basis to dismiss the lawsuit without examining its merits. The accident occurred on February 15, 1995, when H.K. was hit by a car while crossing Morphou Avenue. He became a quadriplegic and lost his ability to speak. The case has gone through many legal phases, with the Supreme Court previously noting the need for a well-organized insurance or social system to address such tragedies. The retrial of the case gives the family of H.K. a new opportunity to seek compensation for the serious consequences of the accident, now focusing on the potential responsibilities of the state and the Municipality of Lakatamia.
