The accident was caused when a car, while in a parking space, reversed and collided with a vehicle traveling normally on the side road. The original court had dismissed the claim, finding the plaintiff's testimony vague, but the Appeal Court ruled that the plaintiff's account was clear and supported by unchallenged testimony. The court emphasized that the driver of the reversing vehicle had a duty to ensure it was safe to move and that the presence of an obstruction to visibility required increased caution. Thus, the Appeal Court decided that the responsibility for the accident lies with the driver of the reversing vehicle and its insurance company.
