Appeal Dismissed: Police Officers' Compensation Claim Over Moscow Posting Fails

Two police officers who were posted to Moscow in 2003 attempted to claim compensation of €230,430 each following the premature termination of their assignment. Their claim was based on court rulings that annulled the decisions to end their posting, but the Court of Appeal dismissed their appeal. The court ruled that they failed to demonstrate direct financial damage resulting from the initial incorrect decisions, despite multiple annulments by administrative courts. The original posting decision was made by the Council of Ministers as part of efforts to strengthen diplomatic missions for issuing Schengen visas. A series of decisions and annulments followed, with the Commissioner for Administration intervening and arguing that the Minister of Foreign Affairs did not have the authority to terminate the posting. Despite their court victories, the officers were unable to convince the Court of Appeal of direct financial loss.
