Court Overturns Decision to Declare Migrant 'Illegal', Citing Potential Error

The Administrative Court of Appeal overturned a decision by the Administrative Court that had declared a Nepali national an 'illegal' migrant and issued detention and deportation orders. The Court of Appeal ruled that there may have been an error by the competent authorities as to the time of commencement of her illegal stay in Cyprus. The case concerned a worker from Nepal who had arrived in Cyprus as a domestic worker and applied for a residence permit for new employment. The Department of Aliens and Immigration declared her an illegal migrant, as it was considered that she had not found a new employer within the prescribed period. The Administrative Court had dismissed her appeal, but the Court of Appeal found that there was doubt as to the exact date of commencement of the 30-day period for finding a new employer, due to different dates of signature of the release agreement by the employer and the employee. If the date of signature of the employee is taken into account, the deadline had not expired at the time the authorities declared her illegal. The Court of Appeal's decision highlights the importance of accurate documentation and interpretation of legal provisions and contracts.
