The Supreme Court of Cyprus upheld the initial court decision ordering the immediate release of a Syrian asylum seeker, dismissing the Republic's appeal. The case concerned a Syrian citizen who had applied for international protection and had been arrested for the purpose of deportation, but regained asylum seeker status by reopening the asylum process. The Court ruled that the detention of the asylum seeker was not adequately justified, as there were no specific facts to prove that the asylum application was submitted solely to delay or obstruct deportation. Simply repeating the conditions of the legislation was not enough. This decision is particularly important for the limits of administrative detention of asylum seekers and highlights the need for clear and specific justification for detention decisions, based on objective criteria. The Court agreed that the legality of the issuance of the detention order could not be examined within the framework of the privileged jurisdiction for issuing a habeas corpus warrant, but should be examined through an appeal to the Administrative Court.
