Courts: Creditors Almost Always Win Foreclosure Cases

According to data submitted to Parliament, creditors almost always win court disputes over foreclosure of mortgaged properties. From 2018 to 2026, in over 1,000 court cases involving debt purchase companies, creditors won 1,059, while debtors were vindicated in only 7 cases, and even then with a reduction in debt. These figures indicate that resorting to the courts is not effective in stopping a foreclosure. Instead, debt restructuring and negotiations appear to be more effective solutions. Many proposed laws being discussed in Parliament provide for the involvement of the courts in the foreclosure process, with the aim of protecting debtors.
