Supreme Court Allows Appeal Regarding Casino Search Warrant in Torture Video Case

The Supreme Court has granted an application for a prerogative writ (Certiorari) concerning a search warrant issued for a casino in Larnaca in February 2026. The application relates to the investigation of a video found on a mobile phone depicting torture. The applicant, the casino manager, challenges the warrant, arguing that there was insufficient evidence linking the premises to the offenses. The Supreme Court recalls that to grant such a writ, the applicant must establish a debatable case, as prerogative writs are issued only in exceptional circumstances, when there is a lack or excess of jurisdiction or a violation of the rules of natural justice. The police were investigating a series of offenses, including grievous bodily harm, failure to prevent a felony, assault, possession of a weapon, and extortion, allegedly committed in 2025 and January 2026. During the applicant's arrest, two mobile phones were seized, which contained videos depicting torture. The videos show individuals held against their will, subjected to violence, threats, and beatings by the applicant and another person. In two instances, the applicant is seen holding a gun to the mouth of one of the victims. The court notes that the crucial issue is the connection of the premises to the offenses, and the decision focuses on the adequacy of the evidence for issuing the search warrant.
