These teachers, registered on special lists, were unable to be appointed permanently due to the non-operation of the Pre-Service Training Program, which was a prerequisite for their appointment. The Court emphasized that the Administration had a legal obligation to ensure that 10% of appointments concerned people with disabilities and to take active measures to achieve this, an obligation that overrides any other administrative assessment. This omission caused damage to the teachers, such as loss of seniority and delayed salary progression, and gives them the right to claim compensation.
