Cyprus Supreme Court Upholds Cancellation of University Tender Due to 'Exorbitant' Bid

The Cyprus Supreme Constitutional Court has dismissed an appeal against the cancellation of a tender issued by the University of Cyprus for mechanical works at the Department of Biological Sciences. The tender was cancelled because the only acceptable bid, amounting to €5.9 million, exceeded the budgeted expenditure of €4.4 million by 35%, deemed 'unrealistic' by the relevant council. The appeal by the bidding company was rejected by the Review Authority for Tenders and subsequently by the Administrative Court. The court ruled that the cancellation decision was reasoned and reasonable, as the excessive price could have led to reduced competition in the event of a re-tender. The initial decision to cancel the tender had sparked controversy, as the Evaluation Committee had proposed awarding the contract, believing that the low cost estimate was the result of an error. However, the Rector of the University of Cyprus had appealed to the Audit Office, which argued that a supplementary evaluation report should be requested or the tender should be cancelled and re-announced with the correct cost estimate. The Supreme Constitutional Court's decision confirms the correctness of the tender cancellation and the need for transparency and efficiency in public procurement.
