Reversal in Traffic Accident Case – New Trial to Determine Responsibility

The Supreme Court of Cyprus has ordered a retrial in a traffic accident case, overturning the original decision regarding the allocation of responsibility. The court ruled that the original decision was flawed in its assessment of evidence and reasoning. The accident occurred on the Tseri bypass road and involved three vehicles. The original decision had assigned 50% responsibility to two of the drivers, awarding damages to the injured parties. The Supreme Court found that the original court based its decision on evidence that did not constitute actual testimony and that it did not properly assess the testimonies of those involved. It was also ruled that the content of an insurance company report, which was not admissible as evidence, was taken into consideration. The case will be retried, with the aim of accurately determining responsibility for the accident and compensating the injured parties.
